High Court Decision in favour of Betfair changes the whole gambling Game.


The consequences of the High Court decision for the Australian racing industry are immense.

Firstly all state based legislation which imposes restrictions on out of state wagering operators which have the effect of protecting a local player is now likely to be unconstitutional and therefore invalid.

For example, restrictions on advertising must now be abolished.

Secondly, attempts to use so called "race field" legislation to collect an income stream from wagering operators are also anti-competitive and therefore constitutionally invalid.

Third there are restrictions imposed through racing authorities which cannot now continue to exist.


Undoubtedly racing authorities will be reviewing the High Court decision carefully. It cannot be appealed so they are stuck with the consequences.
